ACCEPTABLE USE POLICY
This Acceptable Use Policy (“AUP”) is a guide to the acceptable use of the Fox Theatre Guest Wireless network facilities and services (“Guest Wireless Network”) for invitees and patrons of the Fox Theatre, Inc. (“Fox Theatre”). Any individual connected to the Guest Wireless Network in order to use it directly or to connect to any other network(s), must comply with this policy, the stated purposes and Acceptable Use policies of any other network(s) or host(s) used,and all applicable laws, rules, and regulations. Fox Theatre MAKES NO REPRESENTATIONS OR WARRANTIES CONCERNING THE AVAILABILITY OR SECURITY OF THE GUEST WIRELESS NETWORK, AND ALL USE IS PROVIDED ON AN AS-IS BASIS BY USING THE GUEST WIRELESS NETWORK, YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS Fox Theatre FOR ANY LOSSES OR DAMAGES THAT MAY RESULT FROM YOUR USE OF THE GUEST WIRELESS NETWORK. Fox Theatre takes no responsibility and assumes no liability for any content uploaded, shared,transmitted, or downloaded by you or any third party, or for anything you may encounter or any data that may be lost or compromised while connected to the Guest Wireless Network. Users must respect the privacy and intellectual property rights of others. Users must respect the integrity of ournetwork and any other public or private computing and network systems.
Suspension and Termination
Fox Theatre reserves the right to disconnect any user at anytime and for any reason. The Guest Wireless Network is provided as a courtesy to allow our guests access to the internet.
Prohibited Uses and Users
Inappropriate use of the Guest Wireless Network is not permitted. This policy does not enumerate all possible inappropriate uses but rather presents some explicit prohibitions that Fox Theatre may include in its broader evaluation of your conduct and usage at any time in order to determine whether a particular use is inappropriate. Nothing may be installed or used that modifies, disrupts, or interferes in any way with service for any user, host or network. For example, without limitation:
-Users will not be granted access to the Fox Theatre intranet or permission to install any software on our computers and any such usage or network behavior is prohibited and cause for immediate disconnection and permanent revocation of access to the Guest Wireless Network.
-Use of the Guest Wireless Network for malicious, fraudulent, or misrepresentative purposes is prohibited.
-The Guest Wireless Network may not be used in a manner that precludes or hampers other user’s access to the Guest Wireless Network or any other networks.
-No one under 18 years of age (“Child” or "Children") will attempt to use or use the Guest Wireless Network and any related services, sites, or applications or share their PI with the Fox Theatre. By agreeing to these terms and using the Guest Wireless Network, you attest that you are the age of consent and no younger than 18 years of age as of the first date of your use of the Guest Wireless Network. Fox Theatre does not knowingly collect PI from anyone under the age of 18-years old. If you are a parent or guardian, and you are aware that your child has provided us with PI, please contact us with notification and details so that we can remove the minor’s information and data records from our servers and computer systems. At the time that we become aware that we have collected PI from a Child or Children without verification of parental consent, we implement technical and/or manual steps to remove that information from our servers and computer systems.
PRIVACY POLICY
Choice and Access
You can choose not to receive emails or texts from us by“unsubscribing” using the instructions in any email or text that you receive from us. Unsubscribing from these communications will not bar us from sending you emails or texts about your account or your transactions with us. As a user of the Guest Wireless Network, you can notify the Fox Theatre regarding and thereby manage your privacy preferences for your Guest Wireless Network-related accounts by emailing: marketing@foxtheatre.org .
Retention of Information
We may retain your records or Personal Information if we are legally required to do so or to fulfill a legitimate interest. We retain your Personal Information for as long as necessary to fulfill the particular purpose for which we collected it. Personal Information that you share or we collect from you through usage of the Guest Wireless Network, such as your name, address, and other contact information, may be collected by the Fox Theatre for marketing and development purposes and to enhance the operation of our Guest Wireless Network and our guests experience during events at the Fox Theatre, as well as to complete a transaction for you, respond to your inquiry, or fulfill some other forms of customer service. By “unsubscribing” you choose not to receive marketing from us, or our partners, by using the instructions at login to the Guest Wireless Network or following the instructions in a related email or text communication.
Data Types Collected
Personal Information
While using our Guest Wireless Network, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Information" or “PI”). Personally identifiable information may include, but is not limited to: Email address First name and last name Internet protocol address Adult status/age Phone number Address, State, Province, ZIP/Postal code, City Cookies and Usage Data
Usage Data
We may also collect information that your browser sends whenever you visit our Guest Wireless Network or when you access the Guest Wireless Network by or through a mobile device ("Usage Data").
This Usage Data may include information such as your browser type, browser version, the pages of our Guest Wireless Network and websites that you visit, the time and date of your visit, the time spent on those websites and webpages, unique device identifiers and other diagnostic data.
When you access the Guest Wireless Network by or through a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device’s unique identification number, the internet protocol address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
Tracking & Cookies Data
We use cookies and similar tracking technologies to track the activity on our Guest Wireless Network and hold certain information.
Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also may be beacons, tags, and scripts to collect and track information and to improve and analyze our Guest Wireless Network.
You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Guest Wireless Network. Examples of Cookies and Trackers we use:
· Session Cookies: We use Session Cookies to operate our Guest Wireless Network.
· Preference Cookies: We use Preference Cookies to remember your preferences and various settings.
· Security Cookies: We use Security Cookies for security purposes.
· Pixels:We use tracking Pixels to note users’ preferences and provide better targeted recommendations for future events, shows and related advertising.
Use of Data
Fox Theatre uses the collected data in furtherance of various legitimate interests, which can include, without limitation:
• To notify you about changes to our Guest Wireless Network,• To provide and maintain the Guest Wireless Network,
• To allow you to participate in interactive features of our Guest Wireless Network when you choose to do so,
• To provide customer care and support,• To provide analysis or valuable information so that we can improve the Guest Wireless Network and theatre experiences of guests,
• To monitor the usage of the Guest Wireless Network, and
• To detect, prevent and address violations of these policies and other technical issues.
Data Transfers
If you are located outside United States and choose to provide information to us, please note that we transfer the data, including PI, to the United States and process it there.
Your information, including Personal Information, may be maintained on, and transferred to, servers and computers located outside of your municipality, county, state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your local jurisdiction. Your consent to these Guest Wireless Network policies in combination with your submission of your PI and other information represents your agreement to that data transfer.
Fox Theatre will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your PI will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal data.
Providers
We may employ third party companies and individuals to facilitate our Guest Wireless Network ("Guest Wireless Network Providers"), to provide the Guest Wireless Network on our behalf, to perform Guest Wireless Network-related Guest Wireless Networks or to assist us in analyzing how our theater, event spaces, concessions, Marquee Club, and Guest Wireless Network are used. Such third parties have access to your PI only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
We may use third-party providers to monitor and analyze the use of our Guest Wireless Network. For example:
Google Analytics
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Guest Wireless Network. This data is shared with other Google Guest Wireless Networks. Google may use the collected data to contextualize and personalize the ads of its own advertising network. Third-party Sites
Our Guest Wireless Network may contain links to other sites that are not operated by us. If you click on a third party’s link, you will be directed to that third party's website. We strongly advise you to review the terms and privacy policy of every website that you visit before initiating your use of every website.
Fox Theatre has no control over and assumes no responsibility for the content, privacy policies or practices of any third-party websites, applications, wireless networks, or services.
POLICY UPDATES
Fox Theatre reserves the right to modify this Terms and Conditions, Access of Use Policy, Privacy Policy at any time. We will provide you with notice prior to the effective date of any changes to this Terms and Conditions, AUP, and Privacy Policy, which will be available at foxtheatre.org prior to that time. Your continued use of the Guest Wireless Network after any change in these Terms and Conditions, AUP, and Privacy Policy will constitute your acceptance of such change.
